How the Verbal Threshold Works

When you purchase auto insurance in New Jersey, you choose between two options:

  • Limitation on Lawsuit Option (Verbal Threshold): You agree to limit your right to sue for pain and suffering in exchange for lower premiums. Under this option, you can only sue for non-economic damages if your injuries qualify as a “permanent injury” as defined by statute.
  • No Limitation on Lawsuit Option (Zero Threshold / Unlimited Right to Sue): You retain the full right to sue for pain and suffering for any injury, regardless of severity. This option costs more in premiums.

What Qualifies as a “Permanent Injury”?

Under N.J.S.A. 39:6A-8(a), to overcome the verbal threshold and sue for pain and suffering, you must demonstrate one of the following:

  • Death
  • Dismemberment
  • Significant disfigurement or significant scarring
  • Displaced fractures
  • Loss of a fetus
  • A permanent injury within a reasonable degree of medical probability (not an objective test, but rather a medically supported conclusion that the injury is permanent)

The most common way to overcome the verbal threshold is through a certification from your treating physician stating that your injury is permanent. Common permanent injuries include herniated discs, torn ligaments requiring surgery, traumatic brain injuries, and chronic pain conditions that do not resolve with conservative treatment.

How the Verbal Threshold Affects Your Case

If you selected the verbal threshold and your injuries do not meet the permanent injury standard, you are limited to recovering PIP benefits (medical expenses, lost wages, essential services) and cannot sue for pain and suffering. This can dramatically reduce the total value of your claim. If your injuries do meet the threshold, you can pursue a full bodily injury claim against the at-fault driver, including compensation for pain and suffering, loss of enjoyment of life, and emotional distress.

Exceptions to the Verbal Threshold

  • Pedestrians and cyclists hit by motor vehicles
  • Persons not covered by any NJ auto insurance policy (e.g., out-of-state residents, passengers without auto insurance in their household)
