What Does PIP Insurance Cover in New Jersey?

Personal Injury Protection (PIP) is the cornerstone of New Jersey’s no-fault auto insurance system. Under N.J.S.A. 39:6A-4, PIP provides coverage for certain expenses and losses resulting from an auto accident, regardless of who was at fault. Every standard auto insurance policy in New Jersey must include PIP coverage. Understanding exactly what PIP covers—and what it does not—is essential for anyone injured in a car accident in Monmouth County and Ocean County, or anywhere in the state.

Medical Expenses

PIP covers reasonable and necessary medical expenses related to injuries sustained in an auto accident. This includes:

  • Emergency room visits and hospital stays
  • Surgery and surgical follow-up care
  • Diagnostic imaging (X-rays, MRI, CT scans)
  • Physical therapy and rehabilitation
  • Chiropractic care
  • Prescription medications
  • Medical devices (crutches, braces, wheelchairs)
  • Mental health treatment related to the accident

The standard PIP medical expense limit in New Jersey is $250,000, although policyholders may elect reduced limits of $150,000, $75,000, or as low as $15,000 to lower their premiums. Choosing a lower limit saves money upfront but can leave you significantly exposed if you are seriously injured.

Income Replacement Benefits

If your injuries prevent you from working, PIP provides income replacement benefits equal to 70% of your gross income, up to a maximum of $700 per week. These benefits are available for the duration of your disability or until your PIP coverage is exhausted. To qualify, you must provide medical documentation that you are unable to perform your job duties because of injuries from the accident.

Essential Services Benefits

PIP also covers essential services that you can no longer perform because of your injuries, such as household chores, child care, and yard work. The benefit is $12 per day for the first 12 months after the accident. While this amount is modest, it acknowledges that accident victims often need help with daily tasks during recovery.

Death Benefits

If an auto accident results in death, PIP provides a $10,000 death benefit to the surviving family members of the deceased. This benefit is in addition to any wrongful death claim that may be filed against the at-fault driver.

What PIP Does NOT Cover

PIP does not cover pain and suffering, property damage, or non-economic damages. Those damages are addressed through a separate bodily injury claim against the at-fault driver. PIP also does not cover injuries sustained in accidents that do not involve a motor vehicle.

How PIP Interacts With Health Insurance

Depending on your policy elections, your PIP may be the primary or secondary payer for medical expenses. If you elected PIP as secondary (to reduce your premiums), your health insurance pays first, and PIP covers the remaining balances such as copays, deductibles, and amounts your health insurer denies. Filing a PIP Claim

PIP claims are filed with your own auto insurance company, not the at-fault driver’s insurer. You must notify your insurer promptly after the accident and submit the required claim forms and medical documentation. There are strict deadlines for filing PIP claims in New Jersey, and missing them can result in denial of benefits.
